Denton firm triumphs in copyright lawsuit

DENTON firm Bridstock Gate Limited, a leading textile designer and distributor, has won a bitterly-fought 18-month copyright claim.

Bridstock Gate, a subsidiary of Evans Textiles whose trading name is Portfolio Home, made a claim after ‘Orkney’, its best-selling and innovative design, was copied.

Portfolio Home, which employs 40 people in Denton at is 60,000 sq ft warehouse in Denton, was advised by intellectual property and commercial law specialists Taylors.

Tony Catterall of Taylors, an affiliate lawyer with Anti Copying In Design (ACID), issued proceedings in the Intellectual Property Enterprise Court on behalf of Bridstock Gate, who demanded undertakings to discontinue the importation and sale of the infringing product, delivery up of residual stock and payment of compensation and costs.

On the morning of the trial the defendants agreed to settle with the terms demanded by Bridstock Gate, including undertakings not to import or sell the infringing products and an inquiry to assess payment of damages and costs.

“The ability to bring proceedings in the Intellectual Property Enterprise Court gives clients who create original designs the opportunity to protect their innovative work without fear of plagiarism.

“The protection of original designs is essential to justify the cost and effort put in to the creation of new products.”

Bridstock Gate Ltd, formerly Bedmaker, was established in 1970 and has become a leading supplier of bed linen, bed sheets, cushions, curtains and towels.

Portfolio Home is a national supplier of home textile products and soft furnishings to some of the most well-known high street and online retailers.
